(1) If the city engineer finds the work for which a permit is applied under Section 3.040 to 3.045 does not constitute a hazard to persons or property and does not interfere with maintenance or contemplated improvement work of the city or with the public convenience, and the nature of the work and the materials to be used in connection with the work are appropriate for the purposes thereof, he shall issue the permit.

(2) The permit shall contain the conditions the city engineer decides are appropriate and proper for the public safety and convenience or as may be in effect or adopted by the city and the time within which the work is to be done, the nature of the work, and the materials to be used in connection therewith.
