(1) There is hereby imposed a fee upon the responsible party for each and every City utility account of a single-family residential subdivision or for each pedestrian street light in a multifamily or commercial development that meets the criteria for a benefiting property, as described in Section 4.803. This fee is deemed reasonable and is necessary to pay for the operations and maintenance of pedestrian-scale street lights within the City. The rate is established in the most recent fee schedule approved by resolution of the City Council.

(2) The pedestrian-scale street light charge described in this section shall apply for each month, or part thereof, during which the utility account is active.
