(1) Except as provided by sections 5.105 to 5.990 or as the context requires otherwise, the Oregon Criminal Code of 1970, as now constituted, relating to criminal liability, defenses, burden of proof, parties to crime, justification and responsibility, governs the construction of offenses defined in section 5.105 to 5.990.

(2) Sections 5.105 to 5.990 shall not apply to or govern the construction or punishment for an offense defined in the Medford Code committed before the date of passage of Ordinance No. 4497. Such an offense shall be construed and punished according to the Code provision existing at the time of the commission of the offense.

(3) When all or part of a section or provision of Chapter 5, Code of Medford, is amended or repealed by Ordinance No. 4497, Ordinance No. 5993, or Ordinance No. 6028, the code provision amended or repealed remains in force for the purpose of authorizing the accusation, prosecution, conviction and punishment of a person who violated the code provision before the effective date of the amending or repealing ordinance.
