(1) A person commits the crime of dangerous fire when the person recklessly starts or maintains a fire capable of spreading if one or more of the following exist:

(a) Damage occurs to any property, including the property of the person responsible for the fire, and one or more of the following conditions applies at the time of the fire:

(i) Extreme fire danger has been declared by the Oregon Department of Forestry (ODF); or

(ii) Days designated by the Fire Chief, or their designee, as having increased fire risk; or

(b) A red flag warning applicable to the City of Medford has been issued by the National Weather Service.
