7.752 Burning Without a Permit.
(1) No person shall attempt, cause, or allow a fire to be initiated or maintained without a permit issued by the Medford Fire Department, unless a permit is not required per subsection (3) of this section.
(2) A permit issued by the Medford Fire Department is required for:
(a) Burning a structure or the other use of fire for training purposes by a fire department in coordination with D.E.Q.; or
(b) Commercial recreational fire, including fires for pleasure, religious, ceremonial, cooking, warmth, or similar purposes; or
(c) Any other type of burning where the fire code official requires a permit.
(3) A permit is not required for:
(a) Outdoor cooking fires, with permission of the property owner.
(b) Fires in outdoor fireplaces that meet the requirements of the Medford Building Department, with permission of the property owner.
(c) Natural gas fueled-only or propane fueled-only fireplace/fire pit/appliances.
(d) The following fires at one- and two-family dwellings.
(i) Recreational fires where the fuel size is limited to three feet by three feet wide and two feet tall; or
(ii) Portable outdoor fireplaces.
(4) Fires not specified by subsections (2) and (3) of this section are prohibited within the City of Medford.
(5) A violation of subsection (1) or (2) of this section is a violation. Each day in which such violation occurs constitutes a separate violation.
