The board (council) may grant specific exemptions under ORS 279B.085(3) or 279B.215(2) under the following conditions:

(1) Exemption from competitive bidding may be granted if the exemption is not likely to encourage favoritism in public contracts or substantially diminish competition and will result in substantial cost savings.

(2) Products may be specified by brand name, mark, manufacturer or seller upon any of the following findings:

(a) It is unlikely that such exemption will encourage favoritism in the awarding of public contracts or substantially diminish competition for public contracts;

(b) The specification of a product by brand name or mark, or the product of a particular manufacturer or seller, would result in substantial cost savings to the City;

(c) There is only one manufacturer or seller of the product of the quality required, or

(d) Efficient utilization of existing equipment or supplies requires acquisition of compatible equipment or supplies.
