(1) A person charged with any offense defined and made punishable by code as a crime shall have the right to trial by jury upon filing written demand with the municipal court at least six days, excluding Sundays and legal holidays, prior to the trial date set by the municipal court.

(2) The trial of any offense defined and made punishable by this code as a violation shall be by the court without a jury.

(3) The City shall have the burden of proving the alleged violation by a preponderance of the evidence.

(4) The defendant may not be required to be a witness in the trial of a violation.
