(1) A person commits the crime of attempted theft when the person intentionally engages in conduct which constitutes a substantial step toward commission of the crime of theft.

(2) Attempted theft of property or services is a crime punishable as prescribed in Section 5.990(3) if the aggregate total value of property or services that are the subject of the attempted theft is $100 or more and less than $1,000.

(3) Attempted theft of property or services is a violation if the aggregate total value of property or services that are the subject of the attempted theft is under $100.
