(1) The City may enter into requirements contracts whereby it is agreed to purchase requirements for an anticipated need at a pre-determined unit price providing the following conditions are complied with:

(a) The contract must be let by competitive procurement based on the City's estimate of the quantities required.

(b) The term of the contract including renewals does not exceed three years.

(2) The City may use State of Oregon requirements contracts using the procedures prescribed by the State. The City may use the requirements contract entered into by another public contracting agency when a formal inter-agency agreement exists between the two agencies.
